Terms of service
1. Using Our Platform
Welcome to refurb.biz (the "Site"). The Site is owned and operated by Casterly Private Limited ("Casterly", "we", "us", "our" or the "Company"). Whether you're browsing from a desktop, a mobile browser, or any other supported device, these Terms of Use set out the rules that apply to your use of the Site and govern your conduct while using it.
The Site is made available for your personal, non-commercial use, and these Terms of Use — read together with our Privacy Policy, Shipping Policy and Cancellation, Refund and Return Policy (collectively, the "Policies"), each of which may be updated from time to time — apply to every product and service offered through the Site.
By using or simply browsing the Site, you are deemed to have accepted these Terms of Use and the Policies, whether or not you have actually read them. If you do not agree with any part of these Terms of Use or the Policies, please stop using the Site immediately. It remains your responsibility to ensure that your use of the Site is lawful wherever you access it from.
We may amend these Terms of Use or the Policies at any time and without advance notice. Any changes will take effect as soon as they are published on the Site. If you continue to use the Site after an update, such continued use will constitute your acceptance of the revised Terms of Use and Policies. We recommend that you review these documents periodically for any changes.
2. How We Handle Your Data
Protecting your personal information matters to us, and our Privacy Policy explains how we go about it. Simply put, using the Site means you're agreeing to the collection, use and disclosure of your personal information as set out there, as it may be revised from time to time.
Carrying on using the Site after any such revision means you accept the updated Privacy Policy, so do check it every so often to stay up to date on how your information is looked after.
3. Your Account
The Site is meant for people aged 18 and over. Where a minor does access the Site, we assume this happens under a parent or guardian's supervision — we do not knowingly gather information from children.
Setting up an account with us means you agree to keep your login details (including your password) confidential, take responsibility for whatever happens under your account, and give us accurate, complete information that doesn't tread on anyone else's rights.
Think someone else has got into your account? Let us know right away using the contact details below. Depending on the circumstances, we may ask you to change your password, put a temporary hold on your account, or take other steps to keep it secure.
If you're using the Site for someone else — a company, for instance — you're confirming that you have the authority to bind them to these Terms. Should they later refuse to be bound, you agree to be personally liable for any loss that results from unauthorised use of the Site.
Having an account means you may hear from us with updates and service-related communications. You're welcome to opt out of anything non-essential via the unsubscribe link in our emails, though essential account and service notices will keep coming regardless.
We may suspend or close accounts, or decline to provide the service, without notice, if we believe these Terms have been breached or doing so is otherwise necessary to protect our interests. Whatever you upload, post or otherwise transmit through the Site remains your responsibility, and any information you give us is dealt with in line with our Privacy Policy.
4. Product Information
We do our best to describe products on the Site accurately and in reasonable detail, but we can't promise that every description, colour, specification or other piece of content is completely accurate, complete, up to date or free of error. Nor do we guarantee that a feature mentioned in a listing — say, backlighting or a fingerprint sensor — will actually be present. Typos and inaccuracies can creep in, and product photography is for illustration only and may not exactly match what you receive. Where we spot a mistake, we'll fix it as quickly as we reasonably can, and we reserve the right to correct, update or amend listings at any point, even after you've placed an order, without giving prior notice.
5. Permitted Use of Products
Any products, services or samples you obtain from us — through the Site or otherwise — are for your own personal or professional use. They're not to be resold, whether for commercial gain or any other purpose.
6. Pricing
We work hard to keep pricing and product details correct, but the odd error can occur, and we'll correct it as soon as reasonably possible once it's spotted.
Where a product's price or details are wrong because of a technical or typing error, we may refuse or cancel any order placed for it, unless it's already been delivered to you. In that case, we'll either get in touch to agree next steps or cancel the order and let you know. Any payment already taken will be refunded to the card or account used.
Prices and stock levels can change at any time without notice, entirely at our discretion. If we're unable to deliver a product, whether at all or within the expected timeframe, we'll email you and may cancel the order. We won't be responsible for any loss connected with a cancelled order or a delivery delay.
7. Cancellations, Refunds and Returns
For the full detail on cancellations, refunds and returns, please see the Warranty and Support page on the Site.
8. How You Can Pay
You can pay for products on the Site by credit card, debit card, net banking, digital wallets, e-gift cards, or reward points. Credit card, debit card and net banking payments are processed instantly and are the quickest way to get your order moving.
9. Intellectual Property
Every trademark, logo, product name, design mark and slogan appearing on the Site ("Marks") belongs to us. We don't grant any licence or right to use them without our prior written consent, and unauthorised use is strictly off-limits.
Everything else on the Site — text, software, processes, technology and the rest — is our intellectual property, protected under Indian copyright law and relevant international treaties. Other than for personal, non-commercial use, you may not copy, republish, transmit or otherwise distribute Site content without our written permission, and downloading something from the Site doesn't hand you any ownership or rights over it.
10. Misinformation and False Claims on Social Media
This section explains how we respond when false, misleading or defamatory statements about Casterly.shop, our people, products or services appear on social media, and it applies to anyone — customers, competitors, staff, former staff, suppliers or other third parties — who publishes that kind of material on any platform, be it Facebook, X, LinkedIn, Instagram, YouTube, a blog, a forum, or elsewhere online.
For these purposes, misinformation and false claims cover things like factually incorrect or misleading statements, defamatory comments that damage our reputation, false allegations about how we run our business, malicious reviews aimed at undermining our credibility, and fraudulent claims about our products or operations.
We keep an eye on social media for this sort of content using a mix of automated monitoring tools, reports from our own staff, and, where needed, third-party reputation-management services.
When something is flagged, our legal and communications teams assess whether it genuinely amounts to misinformation or defamation, carrying out an internal review where necessary. If it looks unintentional, we'll usually reach out to the person or organisation responsible and ask them to correct or withdraw it; where the source is a customer, employee or supplier, we'll first try to sort things out amicably. We may issue a public clarification where that's warranted. If the content is deliberate and damaging, we may send a cease-and-desist letter demanding it be taken down, and in cases of serious or repeated defamation we may pursue legal action — including a defamation claim, an injunction to have the content removed, or a claim for damages to our reputation. We also reserve the right to report fraudulent claims to the relevant regulators or law enforcement.
Staff are not permitted to use social media in ways that could damage our reputation; internal concerns should go through the usual HR channels instead, and employees who spread misinformation about the Company may face disciplinary action, up to and including dismissal.
Where misinformation spreads widely, we may respond with an official statement on our website and social channels, work with credible media outlets to set the record straight, and pursue legal routes to secure retractions or corrections from those responsible.
11. Limited Licence
We grant you a limited, non-exclusive, non-transferable licence, which you can't sub-license to anyone else, to access and use the Site for personal, non-commercial purposes. We may withdraw this licence and your access to the Site at any time, at our sole discretion and without prior notice.
12. Keeping the Site Secure
You must not attempt to compromise the security of the Site. That includes, among other things, accessing data or accounts that aren't yours, probing or testing the Site's systems for vulnerabilities without authorisation, disrupting the Site through malicious software, overloading its systems, spamming or mail-bombing, or forging headers or other identifying information in emails or postings.
Breaching Site security may expose you to civil or criminal liability. We reserve the right to investigate any such breach and to cooperate with law enforcement in pursuing those responsible.
We report cybersecurity incidents to the relevant statutory authorities and cooperate with them as required. Where the law requires it, we may need to hand over user information to law enforcement within 72 hours to support investigation of cybersecurity offences. Data collected through your use of the Site is kept for a minimum of 180 days, in line with applicable law.
13. Content You Submit
"Content" here covers pretty much anything you make available on the Site — location details, logos, images, video, audio, comments, data, text, photographs, software, scripts and graphics. Anything you add, upload, create or post while using the Site is a "User Submission".
You're solely responsible for any Content or User Submission you put up, whether it's shared publicly or sent privately, and we can't vouch for how genuine any of it is, whether about you or about products sold on the Site. You accept that (i) engaging with other users' Content or Submissions is at your own risk, and you're responsible for any resulting loss or damage; (ii) we're not liable to you or anyone else for loss or damage arising from User Submissions or Content; and (iii) it's on you to make sure whatever you post is genuine — we take no responsibility for that.
By submitting Content or a User Submission, you give us a worldwide, exclusive, royalty-free licence to use, reproduce and distribute it as we see fit.
You must not display, upload, edit, publish, transmit, update or share anything on the Site that: belongs to someone else and that you have no right to share; is harmful, harassing, blasphemous, defamatory, obscene, pornographic, exploitative of children, invasive of someone's privacy, hateful, or connected to money laundering, gambling, or is otherwise harmful in any way; is likely to harm minors; infringes a patent, trademark, copyright or other proprietary right; breaks any applicable law; misleads the recipient about where a message came from, or is grossly offensive or menacing; impersonates or defames someone else; carries a virus or other code designed to disrupt or damage a computer system; or threatens India's unity, integrity, defence, security or sovereignty, harms its relations with other states, disturbs public order, or encourages a criminal offence.
14. Representations and Warranties
The Site is provided "as is". We make no promises about the correctness, accuracy or reliability of anything on it, and we won't be liable for loss suffered because someone relied on Site content, directly or indirectly.
You accept that the Site is provided only on the basis set out in these Terms, and that uninterrupted access can't be guaranteed — internet or telecoms outages, or scheduled maintenance and other service work, may get in the way, and these are things beyond our reasonable control.
We may change or discontinue any part of the Site at any time, including its content, opening hours, or the equipment needed to access it, and we may stop publishing particular information or categories of information altogether. We take no responsibility, and won't be liable, for any loss connected with your ability, or inability, to access or use the Site.
15. Disclaimer of Warranty and Limitation of Liability
The Site is provided "as is". Neither we, nor our holding companies, subsidiaries, affiliates, partners or licensors, make any express or implied promises about these Terms, the Policies, the Site or its content — including as to merchantability, non-infringement or fitness for a particular purpose — except where the law says such promises can't be excluded.
To the fullest extent the law allows, none of us will be liable (whether under contract, in tort including negligence, or otherwise) for business interruption; delays or interruptions in accessing the Site; loss, theft, corruption, mis-delivery, destruction or non-delivery of data; loss or damage connected with third-party links on the Site; viruses, system failures or malfunctions; inaccuracies or omissions in content; or anything else beyond our reasonable control.
Also to the fullest extent the law allows, none of us will be liable for indirect, special, incidental, consequential or punitive damages — including lost profits — arising from your use of the Site or its content, even if we've been told such damages might happen. Our total liability to you will never exceed whatever you've paid, if anything, to access the Site.
16. Ending These Terms
These Terms stay in force until either you or we bring them to an end. You can walk away at any time simply by stopping your use of the Site. We may end these Terms and cut off your access at any time, without notice and without any liability to you. Ending these Terms also brings the Policies to an end. However you or we terminate them, you must promptly delete or destroy anything downloaded or otherwise obtained from the Site, along with any copies. Termination doesn't erase your obligation to pay for anything already ordered, nor does it affect liability that arose before termination.
17. Governing Law and Jurisdiction
These Terms and the Policies are governed by the laws of India, and, subject to the arbitration process below, the courts of Mumbai will have exclusive jurisdiction over any proceedings.
18. Resolving Disputes
Any dispute about how these Terms or the Policies are interpreted, or any other disagreement between us, will go to a single arbitrator appointed by mutual agreement, whose decision will be final and binding. Arbitration will follow the Arbitration and Conciliation Act, 1996 (as amended), with its seat and venue in Mumbai.
None of this stops us seeking urgent injunctive, provisional or interim relief from a competent court to protect our trademarks, other intellectual property, or confidential information, or to maintain the status quo while arbitration is under way.
For orders placed from outside India, the same Act's international arbitration provisions apply, again with Mumbai as the seat and venue.
19. Severability
If any part of these Terms or the Policies turns out to be invalid or unenforceable — including the warranty disclaimers and liability limits above — that part will be replaced with a valid provision that comes as close as possible to the original intent, and the rest will remain in full effect.
20. Entire Agreement
Except where stated otherwise, these Terms and the Policies make up the whole agreement between you and us about the Site, replacing any earlier discussions or proposals, written or oral. If we don't act on a breach by you or anyone else, that doesn't mean we've given up our right to act on that breach, or a similar one, later.
21. General
These Terms are the full and exclusive agreement between us about your use of the Site, replacing anything discussed or agreed beforehand.
We can change these Terms at any time, at our discretion, simply by posting the update to the Site, and the change takes effect immediately. Carrying on using the Site afterwards means you accept the revised Terms. We may also withdraw any right granted under these Terms, with or without notice, and you must stop using the Site immediately if asked to. Where the law requires it, we'll notify you of these Terms — amended or not — at least once a year, and this is one communication you won't be able to opt out of.
Nothing here creates any agency, partnership, joint venture or similar relationship between us. If we don't insist on strict performance of any provision, that doesn't stop us insisting on it later, and waiving one breach doesn't mean we're waiving the provision itself. Should any part of these Terms be found unenforceable or invalid by law, that won't invalidate the Terms as a whole — instead, the relevant body will adapt that part as closely as possible to its original intent. Headings are included for convenience only and don't affect interpretation.
22. Partner and Affiliate Coupon Codes
Coupon codes issued through partnerships or affiliate arrangements won't work during sale periods, but become valid and redeemable again once the sale ends.
